Anti-Spam Policy

Banana Mail does not tolerate spam. If we identify a client's account is being used for spam we will terminate their accounts. The Policy

In addition to agreeing with our Terms and Conditions, allowable use of Banana Mail includes the sending of recipient solicited graphical newsletters, brochures, promotions, invitations, press releases, product launches and other email campaigns that keep registered customers or members informed.

Banana Mail does not allow Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE - also known as spam). If the recipient has not verifiably granted deliberate permission to receive the email, it will be classified as UCE or UBE. Verifiably granted deliberate permission is (1) written or email proof that the recipient has asked to receive the mailing; (2) electronic proof such as a time/date stamp and originating IP address demonstrating that the recipient did agree to receive such email.

So to clarify, this means you can send to anyone who has opted in to your list via your website, offline or via a co-registration site. You can send on behalf of your customers, if their list are opted in via their website, offline or via a co-registration site.

And to clarify, what is NOT allowed:

•    emails harvested from websites
•    lists purchased from a 3rd party
•    rented list from a 3rd party
•    lists that belong to another organization (like a chamber of commerce or a club)
•    any unsolicited list even if it is a press release to reporters, prospective customers, prospective voters or potential employers or anyone who has not given you permission to send to them.
•    Sending emails to discussion groups

Policy enforcement - what we do to eliminate spam

Banana Mail users must explicitly certify that their lists consist of 100% certifiable opt-in email addresses. Inability to supply such proof upon request may result in account termination.

Banana Mail reserves the right to monitor all imported lists. This monitoring may include an audit of a client’s lists where we at a minimum will request: list source, list age, list collection and confirmation policies.

Banana Mail monitors the content of client’s emails and flags messages that have content commonly used in unsolicited emails. A match on a send may result in a send being held in queue, until support is able to contact the sender.

Banana Mail maintains IP address and date subscribed for every new subscriber that come through subscription processes we manage.

If a client is found to be using Banana Mail to send Unsolicited Email, we reserve the right to immediately terminate the client’s account without recourse to refund.

An unsubscribe and abuse link is annexed by Banana Mail to the footer of every outgoing email. Any efforts to disable this link will result in an immediate suspension of the account.

Complaints Procedure

If we suspect that your account has been used for sending unsolicited bulk emails or spam, your account’s sending privileges will be temporarily suspended. To determine whether or not you have sent spam, we will:

Review the complaint

Review your list for patterns common to harvested lists

Review the content of the email in question

Review the opt-in proof for the email address in question

If we determine, that you did indeed spam, then your account will be suspended without recourse to refund.

If we determine, that the complaint was a false-positive (someone who subscribed, but has forgotten that they had subscribed), then we will liaise with both you and the complainant for proper resolution. Upon proper resolution, sending privileges on your account will be reinstated.

ISP and Blacklist relationships

We share information regarding our policies and practices with Blacklist administrators and ISPs and are genuinely keen to discuss potential improvements to reduce any abuse. What information Banana Mail gathers and tracks

Banana Mail collects three types of information:

1) personal (name, email address and telephone number) or company information that you knowingly disclose when signing up to trial or purchase Banana Mail;

We use the latest product releases from Microsoft and other companies to ensure our systems always rate good against industry standards. Our operating systems and software are always up to date with the latest security patches and updates.

Firewalls are used extensively to protect data by opening only the necessary channels to the necessary entities on our servers. This means that if a PC or location does not need to have access to our servers for our system to work properly, they will not be able to contact that server. This greatly reduces the chances of hackers being able to penetrate our system. We use the latest AntiVirus software to scan our servers in real time against any suspicious files and/or traffic. Virus definitions are updated multiple times per day.

All our software runs on RAID hard drives to prevent downtime in the event of hardware failure. We also protect our data from hardware failure or disaster events by running daily backups.

All employees sign a privacy agreement when they join Banana Mail that prevents them from using, disclosing or selling any user information.

Our policy on correcting and updating personally identifiable information is as follows: Banana Mail gives you as much control as possible over your personal information. To update your PII all you need to do is login to your account, select the Setup and Options tab on the left hand navigation bar and make the necessary changes.

PII Information collected is purely for the purposes of identifying users and account purposes. No PII is collected through any tracking technologies. But website user data generated from tracking technologies are tied into PII for the sole purpose of better understanding the effectiveness of marketing campaigns. This data is in turn used to identify potential target markets, to streamline communications to clients and prospective clients and to aid in the development of a better product. The information collected through tracking technologies include: search behaviour, site traffic, time on site, referring ad campaigns and information on drop off points of traffic.

Service Providers

Customer Support Online Chat Messenger

The online chat service Banana Mail provides, gives our clients the opportunity to contact us directly (during office hours) should they have queries of any sort. The chat button is currently in the Banana Mail website.
The chat window allows us to view various information from the client such as geographic location, which browser they are using, the current web page they are viewing, IP address, country etc.

The tool also allows us to build up a knowledgebase and a FAQ section using the correspondence received via the online chat and can be used to build up the content. The service is available provided that there is someone signed in and online. None of the information collected is made public.

WorldPay and Secure Trading

We use WorldPay and Secure Trading to provide payment services. They are online payment gateways which make subscribing and purchasing quick and easy for our clients. Payment details are encrypted and sent to the payment secure trading processing gateway. All payments are linked and identified to a transaction ID, but when a client selects to subscribe for a monthly subscription this subscription is identified and linked to a unique ID. This unique ID is used to initiate recurring payment. Within the unique ID the particulars of the client is viewable such as when the subscription [date, time] was made as well as the client name, address, contact no. and number payments made.

The information obtained from clients at payment is not stored by Banana Mail. These confidential details [credit card details] are stored only at the Merchant bank (WorldPay and European Merchant Services) therefore Banana Mail does not have access to these details. WorldPay or Secure Trading notifies us of payment failures, warnings and cautionary payments and credit card expires. The link between WorldPay or Secure Trading and Banana Mail will automatically suspend clients when payment has failed and this is done by warning both from WorldPay and Banana Mail. Should the client wish to upgrade or down grade their subscription the existing and present unique ID is cancelled and a new unique ID is allocated to the subscription. Clients can cancel at anytime from directly within the account or by an email request to This e-mail address is being protected from spambots. You need JavaScript enabled to view it . The unique ID is then cancelled and this will end all recurring payments.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Google Analytics

Banana Mail uses Google Analytics to learn which online marketing initiatives are cost effective and see how visitors actually interact with our your site. Make informed site design improvements, drive targeted traffic, and increase your conversions and profits.

Banana Mail SMS

The Banana Mail SMS/Text sending facility is covered by this privacy statement whereby Banana Mail warrants that it does not share, sell, rent, or trade PII, including mobile telephone numbers stored within the Banana Mail clients' datasets, with any third parties for their promotional purposes. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on our Web site.

The Short Message Service - Point to Point, SMS-PP, as defined in Global Systems for Mobile communication standard, recommendation 03.40, as used for sending Text/SMS messages by the Banana Mail Text/SMS service, does not provide for an unsubscribe mechanism. Recipients of unwanted information sent to them through the Banana Mail system by way of text/SMS should email This e-mail address is being protected from spambots. You need JavaScript enabled to view it   stating the message content in the SMS. Within 72 hours of receipt their mobile telephone number will be added to the block list of the sending account.

Testimonials

Banana Mail posts customer testimonials on the site which may contain personally identifiable information.
